Regulations of the People's Republic of China on the Protection of Safety and Security of Civil Aviation

Order of the State Council of the People's Republic of China No. 201 The Regulations of the People's Republic of China on Civil Aviation Security and Protection are hereby promulgated and shall come into effect from the date of promulgation. Premier: Li Peng July 6, 1996 Regulations of the People's Republic of China on the Protection of Safety and Security of Civil Aviation Chapter 1 General Provisions Article 1: In order to prevent illegal interference with civil aviation activities, maintain civil aviation order, and ensure civil aviation safety, this regulation is formulated. Article 2: This regulation applies to all civil aviation activities within the territory of the People's Republic of China, as well as to units and individuals related to civil aviation activities. Civil aircraft with Chinese nationality engaged in civil aviation activities outside the territory of the People's Republic of China shall be subject to this Regulation; However, except as otherwise provided in international treaties concluded or acceded to by the People's Republic of China. Article 3: The principle of unified management and division of labor responsibility shall be implemented for civil aviation security and protection work. Civil aviation public security organs (hereinafter referred to as civil aviation public security organs) are responsible for the unified management, inspection, and supervision of civil aviation security and protection work. Article 4: Local governments and civil aviation units shall closely cooperate to jointly maintain civil aviation safety. Article 5 Passengers, consignors and consignees of goods, as well as other personnel entering the airport, shall comply with the laws, regulations and rules of civil aviation safety management. Article 6: Civil airport operators and civil aircraft operators shall perform the following duties: (1) Develop a civil aviation security plan for our unit and submit it to the competent civil aviation authority of the State Council for filing; (2) Strictly implement measures related to civil aviation security and protection; (3) Regularly conduct civil aviation security training to promptly eliminate hidden dangers that endanger civil aviation safety. Foreign civil aviation enterprises that operate with the People's Republic of China shall submit civil aviation security and protection plans to the competent civil aviation authority under the State Council. Article 7: Citizens have the right to report to the civil aviation public security organs acts of premeditated hijacking, destruction of civil aircraft, or other acts that endanger civil aviation safety. Article 8: Units or individuals who have made outstanding contributions to maintaining civil aviation safety shall be rewarded by the relevant people's governments or the competent civil aviation authorities under the State Council. Chapter 2 Security and Protection of Civil Airports Article 9: The construction, renovation, or expansion of civil airports (including the civil part of military civilian joint airports, the same below) shall comply with the regulations of the competent civil aviation authority of the State Council on the construction of security facilities for civil airports. Article 10: Civil airports that are open for use shall meet the following security and protection conditions: (1) Establish an airport control area and equip it with dedicated security personnel; (2) Equipped with standard protective fences and patrol channels; (3) Establish a security organization and equip it with corresponding personnel and equipment; (4) Establish safety inspection agencies and equip them with personnel and inspection equipment that are suitable for the airport's transportation volume; (5) Establish a dedicated firefighting organization and equip personnel and equipment according to the airport's firefighting level; (6) Develop emergency response plans and equip necessary emergency rescue equipment. Article 11: The airport control area shall be designated as a waiting and quarantine area, luggage sorting and loading area, aircraft activity area and maintenance area, cargo storage area, etc. according to the needs of security and protection, and safety protection facilities and obvious signs shall be set up separately. Article 12: The airport control area shall have strict security measures and implement closed zone management. The specific management measures shall be formulated by the competent civil aviation authority of the State Council. Article 13: Personnel and vehicles entering the airport control area must wear an airport control area pass and undergo inspection by security personnel. The airport control zone pass shall be issued and managed by the civil aviation public security organs in accordance with the relevant regulations of the competent civil aviation authority of the State Council. Article 14: Personnel and vehicles within the aircraft activity area and maintenance area must follow the prescribed route, vehicles and equipment must be parked in designated locations, and all personnel and vehicles must avoid the aircraft. Article 15: Civil aircraft parked at airports must be guarded by dedicated personnel; All relevant departments and their staff must strictly implement the aircraft security handover system. Article 16: The following behaviors are prohibited within the airport: (1) Climbing (drilling), damaging airport protective fences and other safety protection facilities; (2) Hunting, grazing, drying grains, and coaching driving vehicles within the airport control area; (3) Entering the airport control zone without an airport control zone pass; (4) Crossing aircraft runways and taxiways at will; (5) Forcefully boarding or occupying aircraft; (6) Falsifying dangerous situations and creating chaos; (7) Other behaviors that disrupt airport order.Chapter 3 Security and Protection of Civil Aviation Operations Article 17: The carrier and its agents must comply with the relevant regulations of the competent civil aviation authority under the State Council when selling tickets Ding; Those that do not comply with regulations shall not be sold as tickets. Article 18: When handling the procedures for carriage, the carrier must verify the passenger and luggage. Article 19: When passengers board the plane, the carrier must verify the number of passengers. Passengers who have already checked in but have not yet boarded are not allowed to have their luggage loaded or left inside the aircraft. Passengers must unload their luggage when they stop traveling during the flight of the aircraft. Article 20: The carrier must have a dedicated person to supervise the storage and transportation of luggage and cargo on the ground. Article 21: Units that prepare and load supplies must ensure the safety of the supplies loaded into aircraft. Article 22: The safety and security of aircraft during flight shall be the unified responsibility of the captain. The aviation security officer, under the leadership of the captain, is responsible for the specific work of security and protection. The captain, aviation safety officer, and other members of the crew shall strictly perform their duties to protect the safety of the civil aircraft and its passengers and property. Article 23: When performing duties, the captain may exercise the following powers: (1) Before the aircraft takes off, if it is found that the relevant parties have not taken the safety measures stipulated in this regulation for the aircraft, it shall be refused to take off; (2) During aircraft flight, necessary disciplinary measures shall be taken against those who disrupt the order inside the aircraft, interfere with the normal work of the crew, and refuse to listen to dissuasion; (3) Take necessary measures against hijacking, damaging aircraft or other acts that endanger safety during aircraft flight; (4) When encountering special circumstances during aircraft flight, make the final decision on the disposal of the aircraft. Article 24: The following acts that disrupt the order of civil aviation operations are prohibited: (1) Selling ticketing documents, tickets, and valid booking vouchers from air transport companies; (2) Using someone else's ID card to purchase tickets or board a plane; (3) Using a ticket to transport or carry non passenger luggage items; (4) Load items that have not undergone security checks or taken other security measures into the aircraft. Article 25: The following behaviors are prohibited inside aircraft: (1) Smoking in non-smoking areas; (2) Seize seats and luggage compartments (racks); (3) Fighting, drinking excessively, and provoking trouble; (4) Theft, intentional damage, or unauthorized movement of life-saving items and equipment; (5) Other behaviors that endanger flight safety and disrupt the order inside the aircraft.Chapter 4 Safety Inspection Article 26 Passengers and other personnel on civil aircraft, as well as their luggage and belongings, must undergo security checks; However, except for those exempted from inspection as stipulated by the State Council. Those who refuse to undergo security checks are not allowed to board and will bear the losses themselves. Article 27: Security inspectors shall inspect passengers' tickets, identity documents, and boarding passes, use instruments or manually conduct security checks on passengers and their luggage, and may conduct strict inspections if necessary. Passengers who have undergone security checks should wait for boarding in the quarantine area. Article 28: Staff (including crew members) entering the quarantine area for waiting and their belongings shall undergo security checks. Personnel picking up and dropping off passengers and other individuals are not allowed to enter the waiting quarantine area. Article 29: Diplomatic mail bags are exempt from security checks. Diplomatic couriers and other items carried with them shall undergo security checks; However, except as otherwise provided in international treaties concluded or acceded to by the People's Republic of China. Article 30: Goods transported by air must undergo safety inspections or other safety measures taken. The consignor of goods shall not falsely declare the name of the goods or carry dangerous goods in the goods. Article 31: Airmail must undergo security checks. When suspicious emails are discovered, the security inspection department should work together with the postal department to open packages for inspection and processing. Article 32: Unless otherwise stipulated by the State Council, it is prohibited to carry or transport the following items on board a civil aircraft: (1) Firearms, ammunition, military equipment, and police gear; (2) Controlled knives; (3) Flammable, explosive, toxic, corrosive, and radioactive materials; (4) Other prohibited items stipulated by the state. Article 33: Except for the items specified in Article 32 of these Regulations, passengers are not allowed to carry with them any other items that may be used to endanger aviation safety. However, they may be checked in as luggage or returned by the crew after being brought to the destination in accordance with relevant regulations of the competent civil aviation authority under the State Council. Limit the carrying of household items containing flammable substances. The limited items and their quantities to be carried shall be prescribed by the competent civil aviation authority under the State Council. Chapter 5 Penalty Provisions Article 34: Violation of the provisions of Article 14 of these Regulations or violation of Article 16, Article 24, Paragraph 1 of these Regulations The acts listed in the second item and Article 25 shall be punished by the civil aviation public security organs in accordance with the relevant provisions of the Regulations of the People's Republic of China on Public Security Administration Punishments. Article 35: Those who violate the relevant provisions of this Regulation shall be punished by the civil aviation public security organs in accordance with the following provisions: (1) Those who commit the acts listed in Article 24, Item 4 of these Regulations may be given a warning or fined up to 3000 yuan; (2) Those who engage in the behaviors listed in Article 24, Paragraph 3 of these Regulations may be subject to a warning, confiscation of illegal gains, or a fine of up to 5000 yuan; (3) Those who violate the provisions of Article 30 (2) and Article 32 of these Regulations, but have not yet committed a crime, may be fined up to 5000 yuan, or have their illegally carried items confiscated or detained.Article 36: If any of the following situations occur in violation of the provisions of these Regulations, the competent civil aviation authority may impose a warning, suspend operations for rectification, or impose a fine of up to 50000 yuan on the relevant units; The civil aviation public security organs may impose a warning or a fine of up to 500 yuan on the directly responsible personnel: (1) Violating the provisions of Article 15 of these Regulations, causing the aircraft to lose control; (2) Selling tickets in violation of Article 17 of these Regulations; (3) Violating the provisions of Article 18 of these Regulations, if the carrier fails to verify the passenger and luggage when handling the transportation procedures; (4) Violating the provisions of Article 19 of these Regulations; (5) Violating the provisions of Article 20, Article 21, the first paragraph of Article 30, and Article 31 of this Regulation by failing to take safety measures for the items received and loaded into the aircraft. Article 37: If a violation of the relevant provisions of these Regulations constitutes a crime, criminal responsibility shall be pursued in accordance with the law. Article 38: Those who violate the provisions of this Regulation shall, in addition to being punished in accordance with the provisions of this Chapter, bear the liability for compensation in accordance with the law if they cause property losses to units or individuals. Chapter 6 Supplementary Provisions Article 39: The meanings of the following terms in these Regulations: Airport control zone "refers to an area within an airport that is designated for restricted access based on security needs. The "waiting and quarantine area" refers to the designated area, boarding passage, and shuttle bus in the terminal building (room) for departing passengers who have undergone security checks to wait for boarding according to safety needs. Aircraft activity area "refers to the ground activity area within an airport used for aircraft takeoff, landing, and related activities, including runways, taxiways, taxiways, and passenger aprons. Article 40: This regulation shall come into effect from the date of its promulgation.
